1. Information about personal data collection

In the following we will provide information about the collection of personal data when using our website. Personal data is any data by which you can be personally identified for example: name, address, e-mail address, IP address and user behaviour. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We would like to point out that data transmission on the Internet can have security gaps (for example when communicating by e-mail).

This can be, for example. data that you enter in a contact form. Other data is collected automatically or after your consent when you visit the website by our IT systems. This is mainly technical data (e.g. Internet browser, operating system or time of the page view). This data is collected automatically as soon as you enter the website. Some data is collected to ensure the website works accordantly and without errors. Other data may be used to analyse your user behaviour.  

2.     Your Data Rights 

You can exercise the following rights at any time: ·      Information about your stored data and its processing,·      Correction of incorrect personal data,·      Deletion of data stored by us,·      Restriction of data processing, if we are not yet allowed to delete your data due to legal obligations,·      Objection to the processing of your data by us and·      Data portability, if you have consented to the data processing or have concluded a contract with us. You can revoke your consent at any time in the future. You have the right to object to the processing of your personal data for reasons that arise from your situation, if the data processing is based on art. 6 I 1 lit. f) GDPR, this also applies to profiling based on these provisions. If you object, we will no longer process your personal data, unless we have compelling grounds, which outweigh your personal interests, rights and freedom or the processing serves to assert, exercise or defend legal claims. (Art. 21 I GDPR). You may at any time file a complaint with the supervisory authority responsible for you. Your competent supervisory authority depends on location of the federal state of your residence, your work or location of the alleged violation. 3.     Purposes of data processing by the responsible body and third parties

 We process your personal data only for the purposes stated in this privacy policy. We do not transfer your personal data to third parties for purposes other than those mentioned. We will only share your personal data with third parties if: ·      you have given your explicit permission to do so,·      the processing is necessary to complete the contract with you,·      the processing is necessary to comply with legal obligations, the processing is necessary to protect legitimate interests, if there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data. 

4. Deletion or blocking of data

 We adhere to the principles of data avoidance and data economy. We therefore only store your personal data for as long as it is necessary to achieve the purposes stated here or as long as the various storage periods are provided by law. After the respective purpose has ceased to exist or these periods have expired, the corresponding data is routinely blocked or deleted in accordance with the statutory provisions.  

5. Collection of general information when visiting our website 

When you access our website, general information is automatically collected by a cookie. This information (server log files) includes, for example, the type of web browser, the operating system used, the domain name of your Internet service provider and so on.  This is exclusively information that does not allow any conclusions to be made about your person. This information is technically necessary in order to correctly deliver the content of web pages requested by you and is mandatory when using the Internet. They are processed for the following purposes: ·      Ensuring a smooth connection setup of the website,·      Ensuring the smooth use of our website,·      Evaluating system security and stability, and·      for other administrative purposes. The processing of your personal data is based on our legitimate interest from the above-mentioned data collection purposes. We do not use your data to draw conclusions about your person. Recipients of the data are only the responsible body and, if applicable, order processors. Anonymous information of this kind is statistically evaluated by us, if necessary, in order to optimize our Internet presence and the technology behind it. 

6. Cookies 

Our Internet pages use so-called “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser. In some cases, cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of a third-party company (e.g., cookies for processing payment services). Cookies have different purposes. Many cookies are technically necessary, because certain website functions would not work without them (e.g., the shopping cart function or playing videos). Other cookies are used to evaluate user behaviour or display advertising. Of course, you can also view our website without cookies. Internet browsers are regularly set up to accept cookies. In general, you can deactivate the usage of cookies at any time with help of your browser settings. Please use the “help” function of your Internet browser to find out how to change these settings. Please note that individual functions of our website may not work if you disable the cookies. Cookies which are used for electronic communication (necessary cookies) or provide certain functions that you need (functional cookies, e.g., for the shopping cart function) or to optimize the website (e.g., cookies to measure web audience) are stored on the basis of art. 6 I 1 lit. f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for a technically error-free and optimized service. In case a request for your consent to storage cookies has been made, the request is based on (art. 6 I 1 lit. a) GDPR); the consent can be revoked at any time.  You can put your browser settings in a way that you will get informed about cookies and only allow cookies in specific cases, exclude the acceptance of cookies for certain cases or in general and set up the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.  If cookies are used by third-party companies or for analysis purposes, we will inform you separately about this within the scope of this data protection declaration and, if necessary, request your consent. Cookies cannot be used to launch programs or transfer viruses to a computer. Based on the information contained in cookies, we can facilitate your navigation and enable the correct display of our web pages.

7. SSL encryption 

To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g., SSL) via HTTPS.  

8. Contact form 

If you send us inquiries via contact form, your data from the inquiry form, including the contact data you provided, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent. The processing of this data is based on art. 6 I 1 lit. b) GDPR, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measurements. In all other cases, the process is based on our legitimate interest in the effective processing of the requests addressed to us (art. 6 I 1 lit. f) GDPR) or on your consent (art. 6 I 1 lit. a) GDPR) if this has been requested. The data you provide with the contact form will remain with us until you request for its deletion, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g., after we have completed processing your request). Mandatory legal provisions – in particular retention periods – remain unaffected.  

9. Inquiry by e-mail, telephone or fax 

If you contact us by e-mail, telephone or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent. Processing your data is based on art. 6 I 1 lit. b) GDPR, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests sent to us (art. 6 I 1 f) GDPR) or on your consent (Art. 6 I 1 a) GDPR) if this has been requested. The data you send us via contact requests will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular legal retention periods – remain unaffected. 

10. Social media  

Social plugins from the providers listed below are used on our websites. You can recognize the plugins by the logo. Information, which may include personal data, may be sent to the service provider via plugins and may be used by the service provider. We prevent the unvoluntary and unintentional collection and transmission of data by the service provider with a 2-click solution. To activate a desired social plugin, it first must be activated by clicking on the corresponding button. Activating the plugin will be the only way to collect information and transmit it to the service provider. We do not collect any personal data ourselves via social plugins. We have no influence on the data collection and its use via activated plugins. Currently, the assumptions are that a direct connection to the provider’s services is established and that at least the IP address and device-related information is collected and used. There is also the possibility that the service providers try to save cookies on the used computer. Please refer to the data protection information of the respective service provider to find out which specific data is collected and how it is used. Note: When logged in to a social network at the same time, it is possible to be identified as a visitor of a specific page. 11. Appearances on Facebook and Instagram:

We operate on the “social media” Facebook and Instagram. as well This section will inform you about data processing while using our profile on those networks.

We use these networks to communicate with users of the respective network. We give information such as news and offers of our company.

If you use functions of a respective network (e.g. sharing, rating, commenting) on our profile, you are responsible for your own expressions.

The network does not just process your comments, but also other data, which you can look up in the data protection information of the respective network.

Data disclosed by you may also be processed by the network and other users outside the area of the European Union.

Your data, which is collected on our social media, may also be used for market research and advertising purposes. For example, the creation of user behavior profiles based on your interests, which leads e.g., to advertisements, based on your interests, placed within and outside the platform. For this purpose, networks usually store cookies on your computer. In addition, data about you may also be added by data that is not directly collected from your device.

We, as the provider of this information service, do not collect or process any data about your usage of our service.

Processing your personal data by us is based on our legitimate interests in actual information of users and communication with users, which is based on Art. 6 (1) lit. f. GDPR. If you are asked by the respective providers for consent to data processing (i.e., give your consent, e.g. by checking a checkbox or giving confirmation by using a button) the data processing is legally based in Art. 6 (1) lit. a., Art. 7 GDPR.

Possibility to object

If you do not want a social network to collect data about you via our profile and you do not want this data to be linked with data collected by the respective network from other sources, you must

  1. log out of the respective network before visiting our profile,
  2. delete the cookies present on the device and
  3. close and restart your browser.

If you do log in again, however, the network will recognize you, again.

If you want to request information and exercise your user rights, we want to point out that those requests are most effectively handled by the providers. Only providers have access to users’ data.   1. Purpose of the processing and legal basis
    • The data processing is carried out within the framework of your participation in one of our events. The processing of this data is necessary for the fulfilment of the contracts and is based on Art. 6 para. 1 sentence 1 lit. b DSGVO.
    • Your data will be stored for the duration of the contractual relationship existing between us. After termination of the contractual relationship the further processing of your personal data is restricted. After expiry of the statutory storage obligations the data will be completely and irreversibly deleted by us, unless you have consented to further storage in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO. Legal retention periods on the basis of commercial and tax law regulations are up to 10 years.
    • Occasionally we process your personal data to protect our legitimate interests in accordance with Art. 6 Abs. 1 S. 1 lit. f DSGVO. In particular the maintenance of a lively and continuous business relationship, e.g. in order to send greetings on special occasions or by sending offers of services and products of our organisation is in our legitimate interest.
    • The necessity and scope of the data processing depend on the contractual relationship existing between us.
  2. Transfer of data to third parties

Your personal data will only be passed on to third parties if this is necessary in accordance with Art. 6 Abs. 1 S. 1 lit. b DSGVO for the execution of our contractual relationships and for the maintenance of our business relationships in accordance with Art. 6 Abs. 1 S. 1 lit. f DSGVO. This includes IT service providers whose support activities cannot be ruled out that they take note of your data and other contractual partners who process your data on our behalf and who are bound by instructions, academic exchange services, universities and possibly your scholarship provider as well as lawyers, tax consultants, auditors, financial or judicial authorities, government agencies or public institutions (upon request and to the extent permitted by law). As far as these recipients are not already obliged to secrecy themselves the necessary contracts for secure and confidential data processing have been concluded with all recipients. Wir verarbeiten Ihre Daten grundsätzlich nur an unseren Standorten in Deutschland und übermitteln Ihre Daten innerhalb von EU und EWR. Was Zoom jedoch anbelangt, so wird der Dienst von einem Anbieter aus den USA erbracht. Eine Verarbeitung von personenbezogenen Daten findet daher auch in einem Drittland statt.
  1. Besondere Datenschutzhinweise für die Durchführung von Fernunterricht bei Nutzung des Videokonferenzsystems “Zoom”
    • Wir haben uns in der aktuellen Krisensituation für den Einsatz von Zoom zur Durchführung unserer Kursprogramme entschieden.
Mit dem befristeten Einsatz von Zoom haben wir uns nicht dauerhaft für dieses System entschieden. Für besonders vertrauliche Anlässe ist eine Kommunikation über Zoom aus unserer Sicht nicht geeignet. In diesen Fällen bitten wir Sie daher, uns telefonisch, per Fax oder E-Mail zu kontaktieren. Im Folgenden klären wir Sie aus gegebenen Anlass daher zusätzlich über die Verarbeitung von personenbezogenen Daten im Zusammenhang mit der Nutzung von Zoom auf.

Verantwortlicher im Sinne der Datenschutzgrundverordnung und anderer nationaler Datenschutzgesetze der Mitgliedstaaten sowie sonstiger datenschutzrechtlicher Bestimmungen ist, wie bereits oben erwähnt, IIK Bayreuth e.V. Die Kontaktdaten können Sie oben unter den Punkten 1.2 und 1.3 nachlesen. Zoom ist ein Service der Zoom Video Communications, Inc., die Ihren Sitz in den USA, 55 Almaden Blvd, 6th Floor, San Jose, CA 95113 hat. Wir nutzen Zoom für Telefon- und Videokonferenzen und im Rahmen der Lehre im Zusammenhang mit unseren Sprachkursen (gemeinsam: “Online-Meetings”). Sie können Zoom dabei nutzen, indem Sie sich die zugehörige App herunterladen und die jeweilige Meeting-ID und ggf. weitere Zugangsdaten zum Meeting direkt in der App eingeben. Wenn Sie die App nicht nutzen wollen oder können, sind die Basisfunktionen auch über eine Browser-Version nutzbar, die Sie ebenfalls auf der Webseite von Zoom finden. Hinweis: Sofern Sie die Internetseite von Zoom aufrufen, ist der Anbieter von Zoom für die Datenverarbeitung verantwortlich. Ein Aufruf der Internetseite ist für die Nutzung von Zoom aber nur notwendig, um sich die Software für die Nutzung von Zoom herunterzuladen. Die Datenschutzhinweise von Zoom können Sie unter https://zoom.us./de-de/privacy.html finden. Bei der Nutzung von Zoom werden verschiedene Daten und Datenarten verarbeitet. Der Umfang der Datenverarbeitung hängt unter anderem davon ab, welche Angaben Sie vor bzw. bei der Teilnahme an einem Online-Meeting machen. Folgende personenbezogene Daten sind Gegenstand der Verarbeitung:
  • Angaben zum Benutzer: Vorname, Nachname, Telefon [optional], E-Mail-Adresse, Passwort, Profilbild [optional]
  • Meeting-Meta-Daten: Thema, Beschreibung [optional], Teilnehmer-IP-Adressen, Geräte-/Hardwareinformationen
  • bei Aufzeichnungen [optional]: MP4-Datei aller Video-, Audio- und Präsentationsaufnahmen, M4A-Datei aller Audioaufnahmen, Textdatei des Online-Meeting-Chats
  • bei Einwahl am Telefon: Angabe zu eingehenden und ausgehenden Rufnummern, Ländername, Start- und Endzeit; ggf. können weitere Verbindungsdaten, wie z.B. die IP-Adresse des Gerätes gespeichert werden.
  • Text-, Audio- und Video-Dateien: Sie haben ggf. die Möglichkeit in einem Online-Meeting die Chat-, Frage- oder Umfragefunktion zu nutzen. Insoweit werden die von Ihnen getätigten Texteingaben verarbeitet, um diese im Online-Meeting anzuzeigen und ggf. zu protokollieren. Um die Anzeige von Videos und die Wiedergabe von Audiodateien zu ermöglichen, werden entsprechend während der Dauer des Online-Meetings die Daten vom Mikrofon Ihres Endgerätes sowie von einer etwaigen Videokamera Ihres Endgerätes verarbeitet. Sie können die Kamera sowie das Mikrofon jederzeit selbst über die Zoom-Applikation abschalten bzw. stummstellen.
Um an einem Online-Meeting teilnehmen zu können, müssen Sie zumindest Angaben zu Ihrem Namen machen. Als Rechtsgrundlage für die Verarbeitung personenbezogener Daten ist Art. 6 Abs. 1 S. 1 lit. b DSGVO zu nennen, wenn Online-Meetings im Rahmen von Vertragsbeziehungen durchgeführt werden. Sofern keine vertragliche Beziehung besteht, ist Art. 6 Abs. 1 S. 1 lit. f DSGVO als Rechtsgrundlage anzuführen. Unserer berechtigtes Interesse liegt dabei in der effektiven Durchführung von Online-Meetings und Sprachkursen.
  1. Ihre Rechte als betroffene Person
    • Sie haben uns gegenüber die folgenden Rechte hinsichtlich der Sie betreffenden personenbezogenen Daten:

    • Soweit wir Ihre Daten verarbeiten, weil Sie uns zu bestimmten Zwecken die Erlaubnis mittels Ihrer Einwilligung gegeben haben, können Sie diese jederzeit gem. Art. 7 Abs. 3 DSGVO widerrufen. Ab dem Zeitpunkt verarbeiten wir Ihre Daten nicht mehr.
    • Sofern Ihre personenbezogenen Daten auf Grundlage von berechtigten Interessen gem. Art. 6 Abs. 1 S. 1 lit. f DSGVO verarbeitet werden, haben Sie das Recht aus Gründen, die sich aus Ihrer besonderen Situation ergeben, dagegen Widerspruch Art. 21 DSGVO einzulegen. Vorbehaltlich eines schutzwürdigen Interesses unsererseits werden wir die Verarbeitung zu den widersprochenen Zwecken künftig einstellen.
    • Ihren Widerspruch sowie Ihren Widerruf können Sie an die in den Punkten 1.2, 1.3 und 1.4. genannten Kontaktdaten senden.
