General Terms and Conditions of the Institute for International Communication and Foreign Cultural Work e. V. (IIK Bayreuth e. V.)
- Scope of application
For the language courses and additional services of the Institute for International Communication and Foreign Cultural Work e.V. (IIK Bayreuth e.V.), the following General Terms and Conditions of Contract apply to its contractual partners/participants.
Any conditions to the contrary must be confirmed in writing by IIK Bayreuth e.V. in order to be valid. This formal requirement can only be waived by written declaration.
IIK Bayreuth e.V. offers language courses for professional development for corporate clients and private individuals.
The following conditions apply to all language course services.
German law applies.
- General participation requirements
The events/courses offered are generally designed for adults.
Contractual partners/participants in IIK Bayreuth e.V. events/courses must be at least 17 years of age.
Young people aged 17 and over can also take part after consultation and with a declaration of consent from their legal guardians (including release from the duty of supervision).
The courses are not suitable for young people under the age of 17.
- Event requirements
Events/courses can only take place if the minimum number of participants is reached.
If fewer contractual partners/participants have registered, IIK Bayreuth e.V. shall decide whether to close or continue the events/courses.
In the event of continuation, IIK Bayreuth e.V. shall make the contractual partners/participants a new contractual offer.
This may involve shortening lessons and/or charging a higher fee.
If ongoing events/courses are canceled for reasons for which IIK Bayreuth e.V. is responsible, the fee will be refunded pro rata.
IIK Bayreuth e.V. reserves the right to exercise domiciliary rights for all venues used by it.
Under certain – separately regulated – conditions, contractual partners/participants may be excluded from further attendance at the event.
- Binding registration and reservation of the course place
Registrations can be made by e-mail, online registration form and by telephone.
In the case of telephone registration or registration by e-mail, IIK Bayreuth e.V. will be happy to reserve a place in the selected course for the contractual partners/participants for a maximum of one day.
Until then, an online registration of the contractual partners/participants must be received by IIK Bayreuth e.V..
By registering, the contractual partners/participants accept the General Terms and Conditions (GTC) of IIK Bayreuth e.V.
The submission of online course booking forms is binding and obliges the participant to pay the full fee for the services booked, unless revocation or termination of the booked services is declared in writing within the revocation/cancellation periods.
Registration will be confirmed or registration certificates issued as soon as at least the registration fee has been received by IIK Bayreuth e.V. or IIK Bayreuth e.V. has received an original declaration of assumption of costs from a third party (e.g. confirmation of funding or scholarship, declaration of assumption of costs by the employer).
The decisive factor is the receipt of payment on the organizer’s account or the presentation of receipted payment receipts or declarations of assumption of costs.
Only then is the course place firmly reserved and the contractual partner/participant admitted to the selected event/course.
Registration certificates used to apply for a residence certificate must be returned to IIK Bayreuth e.V. in the event of cancellation or proof of rejection of the visa or residence must be submitted.
- Terms of payment
The fees are indicated for the respective events/courses and lectures.
With respect to the amount of the event/course fee, the applicable German-version price list at the point of registration shall be valid.
The fees for the contractually agreed service must be paid in full in advance and no later than 7 days before the start of the service (i.e. 7 days before the start of the course).
If payment has not been made in full by the beginning of the following day, IIK Bayreuth e.V. has no right to further reservation of a course, unless other conditions have been explicitly stated for a specific service offer or deviations from this regulation have been agreed in writing.
Regardless of the above, the obligation to make payment by the contracting partner/participant shall continue to exist.
IIK Bayreuth e.V. is entitled to charge interest at a rate of at least 5 percentage points above the respective base interest rate.
Furthermore, a processing fee of € 5.00 shall be payable.
The course fee can be paid in cash or by bank transfer.
Payment by EC card on site is not possible. Bank transfers shall be made to the following account:

Bank charges for payment, transfer, etc. shall be borne by the contracting partner / participant.
- Materials
The course fees include costs for textbooks and materials.
- Course change / Course allocation
The classification into a level is based on the online placement test of the IIK Bayreuth e.V.
There is no entitlement to determine the course time (morning or afternoon).
The course time is determined by the organizer, IIK Bayreuth e.V..
- Change of course leader
IIK Bayreuth e.V. reserves the right, for important reasons, to fill events/courses with a different course leader than advertised and to change the venue.
This does not give rise to any right of termination, either ordinary or extraordinary.
There is no entitlement to lessons from a specific instructor.
A change of teacher does not entitle the contractual partners/participants to terminate or withdraw from the contract.
- Certificate of attendance
IIK Bayreuth e.V. will issue a certificate of attendance on request for regular course attendance.
Contractual partners/participants are requested to contact the course management in good time.
The certificate of attendance can only be issued within one year of the end of the course.
- Cancellation, withdrawal, termination by IIK Bayreuth e.V.
IIK Bayreuth e.V. may cancel booked courses/events if the minimum number of participants has not been reached at the start of the course, due to force majeure or if there are other objectively justified reasons.
In this case, IIK Bayreuth e.V. will make suitable alternative offers.
Upon request, the contractual partners/participants will be refunded the full amount paid without deduction of processing or bank charges in the event of a course cancellation.
No course fee will be charged or fees already paid will be refunded.
The contractual partners/participants have no further claims.
In this case, there is in particular no entitlement to reimbursement of reservation costs for travel tickets or similar. IIK Bayreuth e.V. expressly recommends that the contractual partners/participants take out travel cancellation insurance.
- Prevention of the contractual partners/participants
If a contractual partner/participant is unable to take part in all or part of a course after the start of the course for personal reasons (e.g. illness, obstacles under residence law or personal obligations), he/she is not entitled to a refund of the course fees or participation in a course at a later date.
- Obligations of the participants
The contractual partners/participants undertake to observe the house rules applicable at IIK Bayreuth e.V., in particular not to disrupt lessons and to treat IIK Bayreuth e.V. equipment and facilities with care.
IIK Bayreuth e.V. reserves the right to assert claims for damages due to breaches of the obligations arising from sentence 1.
IIK Bayreuth e.V. reserves the right to exclude contractual partners/participants who deliberately or grossly negligently violate the obligations in sentence 1 from participation in events/courses.
- Liability and insurance
The contractual partners/participants attend the events/courses at their own risk.
IIK Bayreuth e.V. accepts no liability for accidents in events/courses or on the way to and from the classrooms and/or damage to or loss of property of the contractual partners/participants, unless IIK Bayreuth e.V. has caused the accident to the person through negligent breach of duty, the damage to or loss of property intentionally or through grossly negligent breach of duty.
The liability of IIK Bayreuth e.V. for damages of any kind, insofar as it is not a matter of damages resulting from injury to life, body or health, regardless of the legal grounds on which they may arise, is therefore limited to cases in which IIK Bayreuth e.V. is guilty of intent or gross negligence.
The course fee does not include insurance cover.
There is no insurance against accidents or against damage to or loss of items brought onto the course.
The contractual partners/participants are responsible for taking out their own health/accident and liability insurance, unless corresponding benefits have been agreed separately.
The contractual partners/participants shall be liable for all damage culpably caused by them, in particular also for damage to accommodation arranged.
14. statutory right of withdrawal according to BGB Cancellation policy for consumers registering via the Internet or by post/e-mail: Right of revocation: You can cancel your contract registration within 14 days without giving reasons by means of a clear declaration (e.g. by letter, e-mail or telephone). Special information: Your right of cancellation shall terminate prematurely, if the contract is fully fulfilled by both parties in accordance with your explicit request before you have exercised the right of revocation. If you have requested that the service should commence during the withdrawal period, you must pay IIK Bayreuth e.V. a reasonable amount corresponding to the proportion of the services already provided by the time you inform IIK Bayreuth e.V. of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract. - Termination / Cancellation deadlines
The declaration of any termination of the contract must be made in writing and must be in text form in order to be effective. § 126 b BGB (e.g. by letter or e-mail).
Ordinary cancellation of a course and, if applicable, of booked accommodation, shall be possible in writing up to two weeks prior to the beginning of the course (in case of certain services, also later; please refer to the respective description of services).
If written notice of termination is received no later than 14 days before the start of the event/course, the contractual partner/participant will be refunded the full amount paid less bank charges, a cancellation fee of €50.00 and, if applicable, a document fee of €25.00.
In case of a later cancellation, the complete course fee shall be due. The cancellation fee shall be charged for every service booked.
Special cancellation terms shall apply to booked examinations.
The right of extraordinary cancellation for important reasons shall not be affected thereby.
- Data protection
The contractual partner/participant agrees to the electronic storage of his/her data.
The IIK Bayreuth e.V. uses the inventory data of the contractual partners/participants and voluntary information to provide its services and for future support with information about the IIK Bayreuth e.V.’s services.
The data will be used by IIK Bayreuth e.V. exclusively to fulfill the purpose of the contract.
The data will not be passed on to third parties for advertising purposes.
Data protection is taken into account in accordance with the statutory provisions (BDSG).
IIK Bayreuth e.V. takes the protection of the personal data of its contractual partners/participants very seriously and adheres strictly to the rules of data protection legislation.
Personal data is only collected on the IIK Bayreuth e.V. website to the extent that is technically necessary.
Under no circumstances will the data collected be sold or passed on to third parties for other reasons.
- Severability clause
Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
- Place of fulfillment / place of jurisdiction
The place of fulfillment is Bayreuth (Bavaria).
The exclusive place of jurisdiction for all disputes arising from and in connection with the contracts of IIK Bayreuth e.V. shall be Bayreuth if the contractual partner/participant is a merchant or a legal entity under public law; otherwise the statutory places of jurisdiction shall apply.
